Welcome to VocalNote. By using our application, you agree to comply with and be bound by the following terms of use.

1. AI Technology

VocalNote utilizes advanced Artificial Intelligence to transcribe and rewrite audio. While we strive for high accuracy:

• We cannot guarantee 100% accuracy in transcription or rewriting.
• Users should verify important information generated by the AI.
• The app is provided "as is" without warranties of any kind.

2. User Conduct

You agree not to use the application to record or process:

• Illegal content or hate speech.
• Confidential or proprietary information that you do not have rights to.
• Audio recordings of individuals without their consent where prohibited by law.

3. Data Loss

Guest Users: Notes are stored locally. Clearing cache or device failure will result in permanent data loss.
Members: Notes are synced to the cloud. While we maintain backups, VocalNote is not liable for data loss due to unforeseen technical failures. Please refer to our Privacy Policy for storage details.

4. Subscriptions & Payments

Payments are processed securely via Polar.sh.

• Cancellations: You may cancel your subscription at any time. Your premium access will continue until the end of the current billing period.
• Refunds: We offer a 30-day money-back guarantee for Lifetime Pass purchases. Monthly/Annual subscriptions are non-refundable generally, but exceptions may be made for technical issues.

5. Limitations of Liability

In no event shall VocalNote be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the application.

6. Developer API & Fair Usage

VocalNote provides a Developer API for automated processing. Use of the API is subject to the following:

• Rate Limiting: To maintain service stability, a rate limit of 10 requests per minute per user/IP is enforced. Exceeding this limit will result in 429 Errors.
• API Billing: API usage is billed on a pay-as-you-go basis using your internal wallet. A minimum balance of $0.05 is required for API functionality.
• Webhook Safety: You are solely responsible for the security and data handling of any Webhook URL you provide in your settings. VocalNote is not liable for data breaches or failures occurring at your webhook destination.
• Liability Shield: VocalNote is not responsible for any damages or legal issues arising from your integration of our API into third-party applications, websites, or workflows.
• Automated Abuse: While we encourage development, any use of the API to scrape data, circumvent security, or perform "Denial of Service" attacks will result in immediate permanent suspension without refund.

7. Fair Usage Policy (FUP)

To ensure a high-quality experience for all users and to prevent system abuse, our standard application "Unlimited" plans are subject to a Fair Usage Policy.

• Personal Use Only: Standard user accounts are for individual use only. Shared accounts are not permitted.
• Usage Cap: While we offer unlimited notes for standard use, usage that exceeds 60 hours of total audio processing per month is considered "Excessive Use."
• Action: In cases of excessive or abusive use, we reserve the right to throttle processing speeds or limit feature access. For high-volume automated processing, please use our Developer API.
